Terms of Service

Draft — pending legal review
This document describes how the service actually works, but it has not been reviewed by a lawyer. If you are relying on it for anything consequential, please contact us first.
These terms
ArtsAssistant is operated by ArtsAssistant LLC, a New Jersey limited liability company. You can reach us at . By creating an account you agree to these terms. If you are agreeing on behalf of a company, you confirm you are allowed to do so.
Two kinds of account
Companies publish job postings, review applications, schedule auditions and record casting decisions. Performers build a profile and apply to postings.
An account belongs to one company. Someone who moves to a different company needs a new account with a different email address.
What we are, and what we are not
We provide software. We are not an agent, an employer, or a party to anything agreed between a company and a performer.
Applying guarantees nothing. We do not promise that any application will be read, that any audition will be offered, or that any role will be cast. Companies decide who they see and who they cast, on their own terms.
We do not verify that a company is who it says it is, or that a posting is genuine. Use the same judgement you would with any audition notice, and report anything that looks wrong.
Your content
Material you upload — photographs, documents, audio, video — remains yours. You give us permission to store it and display it to the companies you apply to, which is what makes the service work. That permission ends when you delete the material or your account.
Only upload material you have the right to share. That includes photographs taken by someone else: a headshot is usually the photographer’s copyright, and it is your responsibility to have their permission.
Do not add someone else’s contact details — a reference or an agent — without telling them. Our Privacy Notice explains how those people can have their details removed.
Company responsibilities
Applications, notes and evaluations recorded against them are yours to manage, and you are responsible for handling them lawfully — including keeping them no longer than you need, and treating applicant information as confidential to your own process.
You are responsible for what your staff do with their accounts, and for removing access when someone leaves.
Acceptable use
You agree not to:
- Post anything unlawful, discriminatory, or deliberately misleading about a role, its pay, or its terms.
- Use the service to collect information about performers for any purpose other than casting.
- Attempt to access data belonging to another company or another user.
- Automate access, scrape the service, or interfere with its operation.
Anything you can see, you can report. Reports go to us, not to the company concerned.
Suspension and closure
You can close your account at any time. We can suspend or close an account that breaks these terms, or where we are required to. Where it is reasonable to do so, we will say why.
Closing an account removes your profile and portfolio. It does not automatically remove records a company holds about its own casting process — see the Privacy Notice.
Availability
We try to keep the service running and to keep your data safe, but we do not promise it will be uninterrupted or error-free. We may change or withdraw features.
Liability
To the fullest extent the law allows, we are not liable for indirect or consequential losses, or for lost opportunity — including a role you applied for and did not get. We do not choose who is cast.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
[A liability cap belongs here — commonly the greater of fees paid in the preceding twelve months or a fixed sum. The figure is a business decision. Two things for your adviser: the service is available internationally, and performers using it are consumers, so UK and EU consumer protection limits how far liability can be excluded against them regardless of the New Jersey governing-law clause above; and this is currently a free service, which makes a fees-based cap meaningless and needs a different answer.]
Changes and governing law
We may update these terms. If a change matters to you, we will tell you before it takes effect.
These terms are governed by the laws of the State of New Jersey, United States, and the state and federal courts located in New Jersey have exclusive jurisdiction — except where the law of the country you live in gives you the right to bring a claim locally, which this clause does not take away.
